The investor's spouse and unmarried children under twenty-one may receive conditional permanent residence, with age determined under any applicable Child Status Protection Act calculation. Marriage disqualifies a child; a twenty-first birthday does not automatically do so if CSPA preserves eligibility.
An immigrant route changes what the family may do
Because this is an immigrant route, the family's position differs sharply from the temporary categories: conditional residents may work and study without any separate authorization, and nobody is confined to a dependent role. The limits are age and marital status. Statutory age-out protection can in some circumstances subtract processing time from a child's age, but it is a calculation with conditions rather than a promise, and no family should treat it as one.
Record every date of birth at the outset and build the schedule around the earliest twenty-first birthday, since nothing later in the process can be accelerated to recover lost time. An adult child outside the limit needs an independent route on his own facts. The condition on residence applies to the whole family included in the petition.
