Count the time before you count anything else
Specialized-knowledge status is limited to five years in total, and previous periods spent in the United States in that category or in a managerial one are generally counted toward the limit. Before the company invests in a petition, list every prior admission with its dates and category, taken from passports, entry records and old approval notices. If three years remain rather than five, the assignment has to be designed around that. This is also the point at which to ask whether a permanent route will eventually be needed, because the answer changes the value of every year that follows.
Know how time abroad affects the count
Periods spent physically outside the United States during an assignment can affect the calculation, and brief trips are treated differently from substantial absences. That makes contemporaneous records genuinely valuable: keep a log of entries and departures from the first admission, retain boarding passes and entry records, and reconcile them annually rather than at the end. A company that can evidence its employee's absences has options at the five-year mark; a company that cannot has only the calendar. This is administrative work, and it is the cheapest insurance available in a long assignment.
Show that the knowledge is the company's own
The petition must identify knowledge of the organization's product, process or procedure, or an advanced level of knowledge of its processes, and must show that the U.S. position requires it. Point to the control logic itself, its version history, the commissioning schedules derived from it and the field data behind them, and identify the technologist's authorship of each. Then explain what makes it different from equipment and methods available on the open market. Familiarity with a widely sold control system, however deep, is knowledge of the industry rather than knowledge of the company.
Describe where the work happens and who directs it
Commissioning at the affiliate's own plants is a straightforward arrangement, because a related entity controls the site and the supervision. Where the schedule includes visits to unrelated customers' facilities, say so and explain who assigns and supervises the work, since a specialized-knowledge employee cannot be placed with a third party principally to supply labour that the third party directs. Set out the reporting line, who pays whom, and the specialized element of the work performed at each location. Vagueness on this point invites a request for evidence that delays the whole assignment.
Explain the actual special or advanced knowledge
Records may include controlled manuals, training histories, product-release material, project records, and detailed statements from knowledgeable managers. The existence of documentation does not automatically defeat a claim, but a statement that the applicant has read the manuals is not enough to establish special or advanced knowledge. Compare the claimed advanced capability with the actual tasks; a role requiring only basic use of the manual may not support the proposed account.
