Hypothetical example: a Canadian-citizen economist in a New Brunswick government policy branch, living in New Maryland, has accepted in principle a position with a U.S. consulting firm that prepares rate-case testimony for utilities. TN is open to Canadian or Mexican citizens for prearranged professional work in a profession listed in USMCA Appendix 2, subject to that profession's own degree, licence or experience rule. Self-employment in the United States is not allowed and any ownership in the U.S. employer has to be disclosed. A Canadian citizen may apply at a port of entry without a visa stamp, or the employer may file Form I-129. A TD family member may study in the United States, but TD status carries no work authorization. The question this page answers is what has to happen, in what order, between the handshake and the first day. A careful first review turns the proposed role into a short comparison table: the treaty profession, the duties that actually fill the week, the degree or licence evidence, and the company that will direct and pay the worker. That table often exposes a title that sounds suitable but a duty mix that does not. Canadian applicants commonly request admission during inspection or preclearance, while an employer may submit an I-129 petition to USCIS when that procedure better fits the facts. TN cannot be used to operate the applicant's own independent business.

Step one: fix the profession before the letter is drafted

Hypothetical example: the consulting firm's draft letter calls the role "senior analyst". The USMCA list includes economist, satisfied by a baccalaureate or licenciatura degree. The letter should describe economic analysis: modelling demand and cost of service, preparing expert reports and testimony, and advising on rate design. Ask the firm to revise the title and the duties to match the profession the applicant will rely on, and have that done before anything else is scheduled. Ask the signatory to identify who assigns projects, approves leave, evaluates performance, and bears the commercial result. Those details make the temporary professional engagement easier to test than a promotional title alone.

Step two: assemble the credential and the citizenship proof

The applicant holds a master's degree in economics from a Canadian university, which more than satisfies the baccalaureate rule. Gather the diploma, transcripts and a valid Canadian passport. A Canadian permanent resident cannot use TN, so the passport is the citizenship evidence. If any degree was earned outside Canada, Mexico or the United States, order a credential evaluation now because it is the slowest document in the file. If the credential is not in English, pair the translation with the underlying record and explain any difference between the diploma's field and the offered profession. Do not wait until travel to discover that a registration is still pending.

Step three: choose the procedure and settle ownership

The applicant will be a salaried employee with no equity, which the letter should state; self-employment and undisclosed ownership are the two facts that defeat TN most often. Then choose between a port-of-entry request, which can be decided the same day, and a Form I-129 petition filed by the employer, which takes USCIS processing time. The choice affects when notice can safely be given. Put the intended start date after the chosen filing or admission step, and preserve a copy of the final support letter. An ownership disclosure should explain voting rights and day-to-day control, not merely list a percentage.

Step four: give notice after the admission, not before

Public-service resignation rules require notice, and a refused port-of-entry request cannot be undone. The safe order is to obtain the TN admission or the petition approval, then resign, then move. An admission can be granted for up to three years, with extensions available while the work stays temporary and the profession still fits. A prudent notice plan identifies the document that will confirm admission and the date work may begin. It also leaves room for a corrected letter or a different procedure if the reviewer finds a mismatch.
