Read the design and commercial responsibilities together
Hypothetical example: an offer initially emphasizes architectural design, but a revised scope makes the applicant responsible for purchasing and construction scheduling. Record the actual weekly tasks and deliverables. Do not assume that working on a building project makes every responsibility architectural practice. Start by placing the actual weekly duties beside the selected profession’s entry, rather than relying on a familiar title. The first review should identify the qualifying credential, citizenship proof, employer relationship, compensation arrangement, and temporary project or role. A signed letter that only calls someone a consultant leaves too much unexplained. Ask the employer to describe who directs the work, what specialised tasks will be performed, and why that work needs the stated profession.
Use the architect qualification as listed
The TN architect entry permits a baccalaureate or licenciatura degree, or a state or provincial licence. Identify the alternative actually established and retain evidence of its validity. A qualifying credential does not waive the destination state’s practice rules, and it does not make unrelated duties fit the profession. Credential analysis should be finished before travel planning. A diploma, transcript, licence, or permitted experience record settles the qualification question only when it matches the chosen entry. Where education records use another language, prepare a complete certified English translation for a USCIS filing. A foreign credential evaluation may be appropriate when the education record needs comparison; it does not transform unrelated study into the credential the entry requires.
Identify the receiving entity and intended period
Explain the employer, compensation, duration and where the professional services will be performed. TN may involve a U.S. or foreign employer. Sole or controlling ownership of the U.S. entity receiving the services is prohibited self-employment; an employer-like contract or nominal supervision does not cure it. A Canadian citizen may apply at a port of entry or through Form I-129 and generally does not need a TN visa stamp. The final decision is whether the papers tell one coherent employment story. Compare the offer, résumé, organizational chart, pay arrangement, and any ownership disclosure. If the applicant will control the client or invoice through a personally controlled venture, pause: TN cannot be used for self-employment. Resolve that structural issue before selecting a border request or employer petition, because a polished letter cannot overcome the wrong working arrangement.
