Treat the release as an unresolved funding event. The applicable filing requirements and available evidence must be assessed before relying on that portion.
Identify who can release the funds and when
Record the legal restriction, responsible institution or party and required documents. Distinguish a release request from actual authority to transfer. Do not seek an unexplained payment detour to avoid the condition. Coordinate the investment’s deadlines with the real funding status and preserve evidence when the restriction changes. Investor-petition approval is not itself residence. The applicable immigrant-visa or adjustment process follows, subject to individual eligibility and visa availability. EB-5 residence is initially conditional. Form I-829 is generally filed during the 90 days before the second anniversary of obtaining conditional residence to seek removal of conditions; use the actual status date, not a payment or project-return date.
Timing has distinct stages: preparation of the investor petition, the applicable immigrant-visa or adjustment stage, two years of conditional residence after admission or adjustment if granted, and the later condition-removal filing. The I-829 is generally associated with the 90-day period before the second anniversary of conditional residence, subject to current instructions. Hypothetical example: a robotic orchard-harvesting investor expects to relocate as soon as the initial petition is approved. That expectation is incorrect because petition approval is not itself permanent residence or work authorization. The household should identify the actual next immigration step and current availability before ending employment or selling housing. Maintain capital-deployment and job-creation evidence throughout the conditional period, not only at filing. The decision is whether the project record can support the later stage as well as the initial investment narrative.
