A family gift made in several currencies requires a clear record of the giver’s lawful source, the applicant’s rights and the actual conversion and transfer path. EB-5 also requires qualifying at-risk capital and job creation. A stated gift amount does not establish the net funds that will reach the investment or resolve restrictions on their use. EB-5 is an immigrant-investor framework with separate evidence questions about lawful capital, qualifying deployment, job creation, and the immigrant-visa or adjustment process. Capital must be placed at risk in the qualifying investment, and the required jobs must be created within the applicable framework. Approval can lead to conditional permanent residence rather than immediate unconditional residence. A practical first review identifies which documents prove the money trail and which ones prove the project’s job-creation plan; neither group replaces the other.

Identify the gift and its conditions

Hypothetical example: a relative agrees to transfer funds held in two accounts, but one portion is subject to a release condition. Document the gift terms and what the applicant can lawfully direct. Do not describe promised money as already received or assume family access to an account establishes ownership. Begin with the source-and-path chronology. For every material transfer, collect records that explain where the funds came from, how they moved, and why each intermediary account was used. Tax records, sale agreements, loan documents, gift records, corporate distributions, bank statements, and wire confirmations may all matter. The narrative should follow the documents in date order. A large account balance without a documented origin may leave the central question unanswered.

Reconcile currency changes and deductions

Keep statements, conversion confirmations and transfer records. Explain dates, rates actually used and charges, distinguishing estimates from completed conversions. A lawful source account and a final receipt should be connected by evidence of the intervening path, not merely matching rounded totals. The investment materials must explain the commercial vehicle, deployment terms, risk of loss, and the job-creation methodology. A reader should be able to distinguish funds already committed from money merely promised and see how the relevant jobs are expected to arise. Do not describe a private investment as risk-free if repayment depends on the enterprise’s performance. The exact project structure determines which economic evidence and timelines need review.

Review the investment separately

Assess the receiving EB-5 arrangement, at-risk terms and qualifying job-creation basis. The giver’s lawful funds do not guarantee that the project qualifies or that the applicant will obtain residence. Keep commercial risk, liquidity and immigration requirements separate, particularly when gift timing creates pressure to commit quickly. The investor must also engage in management or policy formulation. Conditional residence creates a later recordkeeping obligation. Preserve evidence showing that capital remained at risk as required and that the job-creation evidence developed as projected or under the applicable rules. The condition-removal filing is generally associated with the period before the second anniversary of conditional residence, but case timing and visa availability should be verified from current official instructions. A petition approval alone is not permission to live or work permanently without the next immigration step.

Apply the current capital and job conditions

Convert and trace the amount actually received rather than treating a donor’s original currency figure as the U.S.-dollar investment. As of September 7, 2026, the general EB-5 investment threshold is US$1,050,000, or US$800,000 for a qualifying targeted employment area or infrastructure project. Statutory adjustment begins January 1, 2027. Qualifying capital must be at risk, with at least ten qualifying full-time jobs per investor under the applicable rules. Direct and regional-center job evidence follows different methods. Establish lawful source and path as well as the actual investment; a transfer receipt alone does not establish all of these conditions.

Follow the residence and removal-of-conditions sequence

Investor-petition approval is not itself residence. The applicable immigrant-visa or adjustment process follows, subject to individual eligibility and visa availability. The investor must engage in management or policy formulation, and at least ten full-time jobs must be for qualifying U.S. workers. EB-5 permanent residence is conditional for two years. Form I-829 is generally filed during the 90 days before the second anniversary of obtaining conditional residence to seek removal of conditions; use the actual status date, not a payment or project-return date. A spouse and unmarried children under 21 may qualify as derivatives.
