Two findings, not one

Specialized knowledge is knowledge of the petitioning organization's product, service, research, equipment, techniques, management or procedures, or an advanced level of knowledge of its processes. A validated internal protocol with its own data behind it is the kind of thing that fits; a widely held laboratory accreditation is not, however rigorous it was to obtain. The employee must possess the knowledge, and the U.S. position must actually require it, which is a separate question. The first review should identify the precise knowledge, its connection to the organization, and the U.S. tasks that cannot be performed without it. Version-controlled technical files, training records, authorship material, and the U.S. work plan settle those points better than a general statement that the engineer is indispensable. Sequence the review by defining the knowledge before writing the job description. The recurring error is describing ordinary engineering competence, or only a plan to train others, without showing why the affiliate needs this individual's company-specific experience. Also confirm the qualifying corporate relationship and full-time foreign employment inside the relevant three-year window; technical strength cannot replace either requirement.
