Separate the knowledge from the teaching
Transferring knowledge to colleagues is a perfectly ordinary part of these assignments and it is not the problem. The problem is a petition that describes a trainer, because training is a general skill and the category asks what the organization knows that the market does not. Describe the specialized work first: validating the protocol against the affiliate's own equipment and product streams, setting control limits from the company's data, and adjusting the method for local conditions. Then describe the training as a consequence of that work rather than as the purpose of the assignment. Use a two-column task comparison: the specialized technical work on one side and the ordinary orientation or teaching that follows from it on the other. This keeps the petition focused on the work that requires the company-specific knowledge.
Document the protocol and its authorship
Produce the protocol as it exists internally, with its version history, the validation studies behind it, the statistical basis for its control limits, and the internal approvals that adopted it. Connect each element to the named scientist through laboratory notebooks, reports, correspondence and internal presentations. Then set it beside the published standard or the commercially available method and explain the difference in concrete terms. An accreditation held by every laboratory in the field is evidence of competence rather than of specialized knowledge, and a petition that leans on it is leaning on the wrong thing. Preserve authorship evidence before simplifying it for a reviewer. Version history, internal approvals, and source records may establish a connection that a polished technical summary alone cannot show.
Show that the position requires the knowledge
Possessing specialized knowledge and holding a position that requires it are two separate findings, and the second is where thin petitions fail. Write the U.S. job description around tasks that cannot be performed without the company's own protocol: validation on the affiliate's lines, investigation of out-of-specification results using the company's decision rules, and revision of the method where local conditions demand it. Identify what will be handed to local staff once trained and what remains with the transferee. A role that empties out after three months describes a shorter assignment than the one being filed. Ask the U.S. manager to identify the specific business consequence if the role were filled by someone without the knowledge. That answer should correspond to the technical record and to the assignment timeline, not just to a general preference for continuity.
Track the five-year limit and the work locations
Specialized-knowledge status is capped at five years, prior U.S. time in an L category generally counts toward the cap, and periods spent outside the United States can affect the calculation. Keep a log of entries and departures from the first admission. Where the work takes the scientist to the affiliate's customers' premises, explain who assigns and supervises it, because a specialized-knowledge employee cannot be placed with a third party principally to supply labour that the third party directs. Work at a related entity's own laboratory is a far simpler arrangement to describe and to evidence. Maintain a travel log and a list of project locations from the outset. It helps the company calculate time against the applicable limit and explain who directs work when services are performed away from the affiliate's premises.
