OROMOCTO · E-2 FIELD GUIDE

How long can an Oromocto investor keep renewing E-2 for a cleaning business?

THE DIRECT ANSWER

E-2 can be renewed as long as the enterprise continues to qualify and the investor continues to develop and direct it. Each renewal re-examines the business, and E-2 itself provides no direct path to permanent residence.

Renewable while the business qualifies, but never a green card

Hypothetical example: the buyer expects to run the cleaning business for a decade. E-2 has no fixed overall maximum; the visa is issued for the period allowed under reciprocity, admissions are granted in periods of up to two years, and extensions or new visas may be sought while the enterprise remains real, non-marginal and under the investor's direction. Each renewal looks again at the business's operations, staffing and the investor's role, so keep payroll, tax filings and contracts organized from the first year. A business that shrinks to a one-person operation risks being found marginal at renewal. E-2 is a nonimmigrant category with no direct path to permanent residence; a family that wants permanence would need a separate basis, such as an employment-based immigrant category, assessed on its own terms. Plan the first application around consular scheduling and the escrow release date, and avoid closing the purchase before the E-2 decision unless the agreement provides for it.

Hypothetical example: a pet-grooming salon buyer wants to pay the seller immediately so the business opens before summer. First finish the source-of-funds record, execute terms that make the funds committed and at risk, and assemble the operating plan, ownership documents, and treaty-nationality evidence. The purchase agreement and escrow conditions settle whether the money is exposed in the required way. Do not confuse a quick commercial closing with a ready application; an incomplete file can delay both. Choose whether to use a conditional escrow, revise the opening date, or accept the risk of closing before immigration processing. The business must remain real and non-marginal throughout the classification, so keep operating records after entry as well.
