Trace every component separately
Mixed funding is normal and is not a problem in itself, but each component needs its own chain. Sale proceeds need the share or asset purchase agreement, the closing statement and the deposit record; a gift from a parent needs the gift instrument, evidence of the parent's own lawful source and the transfer itself; a withdrawal from a registered retirement plan needs the plan statements, the withdrawal confirmation and the tax slip. Reconcile the components to the amount invested. A single unexplained deposit can stall an otherwise strong petition. A capital ledger should link the source records to every transfer and then to the enterprise's use of funds. The business narrative cannot fill an unexplained gap in that chain.
Show the path as well as the source
Lawful source explains how the money was earned. Path explains how it travelled from there into the new commercial enterprise. Keep consecutive statements for every stop, including the currency conversion and any account used only for convenience. Avoid routing funds through a relative's account or a corporation that plays no part in the investment, because each hop must be explained. Where a business sold years ago, retrieve those records now. Treat the hiring plan as an operating commitment. Payroll, tax filings, and related business records will later show whether the projected positions materialized.
Count the jobs the way the rule counts them
At least ten full-time positions for qualifying U.S. workers must be created, full-time meaning a minimum of thirty-five hours a week. The investor, the investor's spouse and non-immigrant workers do not count toward the total. In a direct investment the jobs must be created by the enterprise itself, and positions that already exist are not new jobs except in the troubled-business context. Obtain the bakery's current staffing and hours first, then set out the hiring the investment funds, with the timing and the payroll records that will later evidence it. Family-age analysis belongs beside the investment timetable. A plausible job forecast cannot preserve derivative eligibility that a birthday has already ended.
Be an investor who is engaged, not passive
The investor must be engaged in the management of the enterprise, through day-to-day managerial control or through policy formulation. A limited partnership interest in a regional-centre project satisfies that differently from a direct investment in an operating company, where the expectation is real involvement. Record the role in the operating agreement: which decisions require the investor's approval, what reporting exists, and what the investor is actually responsible for. A shareholding with no function attached does not meet the standard. Keep the conditional-residence record from the opening transfer onward. Rebuilding years of capital and job history only when conditions must be removed creates preventable risk.
Plan for the conditional period and the second filing
Approval leads to two years of conditional permanent residence for the investor, the spouse and unmarried children under twenty-one. The condition is removed by filing Form I-829 with evidence that the capital remained invested and that the required jobs were created and sustained. Payroll records, tax filings and financial statements from that period therefore matter as much as the first application did. Set the bookkeeping up to produce them from the outset. Confirm whether the investment structure can generate the required evidence through the conditional period, not merely at filing. The governing records will be transfers, payroll, tax filings, and enterprise documents that show both capital deployment and the job-creation result.
